A Santee building contractor was sentenced Thursday to eight years in prison for killing a man he found in bed with his wife.
Terry Michael Pemberton, 36, had pleaded guilty to voluntary manslaughter in the death of Jerald Herrera, also of Santee. Herrera was a one-time boyfriend of Pemberton’s wife, Cheryl.
Pemberton’s attorney, Michael Sideman, told Judge J. Richard Haden the April 7 shooting occurred two days after Pemberton had moved out of his MacCool Lane house to a motel.
Pemberton arrived at his house on the morning of the shooting and found his wife in bed with Herrera.
Sideman said Pemberton grabbed a gun and marched Herrera, who was nude, out of the bedroom. He said Herrera made some type of movement and the gun discharged. Herrera was shot once in the head.
