Vietnamese Catholics fighting the Diocese of San Jose for a separate parish cannot be evicted from the church they have occupied since last summer, Santa Clara County Superior Court Judge Robert Foley ruled. The diocese sought a court order to evict the Vietnamese dissidents from the tiny mission of Our Lady, Queen of Martyrs. But the judge denied the request, calling it “premature and unnecessary.” He said it was essentially a land-dispute case and that the diocese had other legal options, including going to trial.
