Changing conditions may require the government to reconsider some of the mergers it has allowed in recent years, a member of the Federal Trade Commission said. “In some circumstances, it may be necessary to revisit mergers that have already happened if changes in the international trade situation have made the merger anti-competitive,” said Commissioner Terry Calvani in remarks for delivery at the Fordham Corporate Law Institute in New York. There may be cases, Calvani said, in which American producers have persuaded antitrust authorities to permit a merger by contending that import competition is more than sufficient to keep the merged firm from monopolizing the U.S. market. Then after merging, he said, a company could seek protection from import competition from another U.S. agency.
