Should a citizen become involved in a tax dispute with the government and lose his case, that person must post the amount of the monetary judgment, as a bond, to appeal his case to a higher court.
The County of San Diego lost its claim of a half-percent sales tax when Superior Court Judge Gordon Burkhart ruled it illegal March 24.
Why doesn’t the County of San Diego have to return the half-percent sales tax it already collected to the citizens who paid it before the county can be allowed to appeal the case to a higher court?
