In a Switch, Smoker Wins Case in Northeast

Brown & Williamson Tobacco Co. was ordered to pay $350,000 to the family of a deceased smoker.
A hearing will be held Jan. 7 to determine what punitive damages the tobacco company may be assessed, said Michael London, an attorney for the family of smoker Harry Frankson. The verdict is the first in favor of a smoker in New York.
The tobacco industry has won most cases brought by individuals except for several defeats in Florida and on the West Coast, where juries awarded billions of dollars in punitive damages.
